Chief Justice Umar Attabandial inquired that you mean that I should leave the bench? Judiciary is the guardian of basic human rights, you should not interfere with our administrative authority, we have full respect for the government, the government hastily enacted legislation to regulate the powers of the Chief Justice, how the government can select judges for its own purposes. can Your request is respectable, the post of Chief Justice is a constitutional post, I knew you would raise this objection, Judiciary is not subordinate to the federal government, there is separation of powers in the constitution.
Attempts were made to split the judges: Chief Justice
Chief Justice of Pakistan Umar Ata Bandyal raised the question that how was the action taken without consulting the Chief Justice? Even in the Commission of Inquiry Act 1956, there was no consultation, this is a practice, the judge for the commission will be nominated by the Chief Justice, 3 such notifications were withdrawn which did not include the consultation of the Chief Justice, 5 decisions of the Supreme Court in this regard. are also present, please tell the government to follow the spirit of the constitution, consultation was not called for in the Commission of Inquiry Act 2017, an attempt was made to create a rift among the judges without knowing it, the government has included bail and family members in the commission. Also put meters.
Attorney General Mansoor Usman Awan said that this matter can be resolved.
The Chief Justice said that if it is so then go and solve it, then we will also help you.
Attorney General Mansoor Usman Awan said that the full court was requested in the case of Practice and Procedure Act law among others.
The Chief Justice of Pakistan said that in the Practice and Procedure Act, it is written in the law that there should be a bench of 5 judges, your request for a full court was also against this law, we made a bench of 8 judges.
Attorney General Mansoor Usman Awan said that the law called for a bench of 5 judges, so why were there not 5 judges?
